Membership Terms & Conditions

These terms and conditions (these “Terms”) govern membership in the Missouri OHV Alliance, a Missouri non-profit corporation (collectively “we,” “us,” “our,” “ours”). Purchase or use of a membership in the Missouri OHV Alliance (a “Membership”) at any time subjects the purchaser or user (“you,” “your,” “yours,” “Member”) to the provisions of these Terms, as amended by us from time to time.

By accepting your Membership, you certify that you have read, understand, and will abide by the following Terms:  

Benefits.  As a holder of a Membership, you may be entitled to certain benefits.  These benefits only become active upon the issuance of your Membership number, and may be changed by us from time to time. 

Membership Fee.  The annual Individual Membership fee is currently $25.00.  The annual Club Membership fee is currently $50.00.  The annual Business Membership fee is currently $100.00.  Membership fees are subject to taxation in accordance with applicable federal or state law. The annual Membership fees does not include applicable taxes. We may change the Membership fees at any time, but changes will apply only to new and renewal annual Memberships, to include those occurring as part of the automatic renewal program. 

Refunds.  There will be no Membership fee refunds, except for Members enrolled in our Auto-Renewal program who have requested a refund at least 30 days prior to the start or renewal of their Membership.  However, you may cancel your Membership at any time, without a refund, by contacting us at:

We may terminate your Membership, including any associated accounts, without notice, for any reason in our sole discretion, including without limitation our belief that continued use of such Membership would violate any provisions of these Terms, applicable law, or otherwise be harmful to our interests. In the event of any such termination, you will be entitled to a pro rata refund of your Membership fee. 

Term and Termination.  Membership term is one year from the date of purchase.  Renewals or automatic renewals within a current term extend the existing expiration date by one year.  When an expired Membership is renewed, the new term begins on the date that membership dues are processed, and expires one year from that date.  Your Membership will not automatically renew unless you opt in to our automatic renewal program.

Automatic Renewal.  You may opt into our automatic renewal program.  This program allows us to automatically renew your Membership each year with no action on your part. You understand that by agreeing to automatic renewal of your Membership, the annual Membership fee (at the then-current rate) will automatically be charged once a year in your Membership anniversary month to the credit card that you have registered with us, unless you alter or cancel your membership as provided below.  You understand that we will notify you by e-mail at least 30 days before your credit card is charged, and that you reserve the right at that time to alter or cancel your Membership.  If you wish to alter or cancel your Membership, you must provide us at least 10 days notice of your desire to cancel at the following address or telephone number:

In the event that you wish to dispute any charge to your credit card made pursuant to the automatic renewal authorization, you agree to contact us first at the address or telephone number above to resolve the dispute. You also authorize us to charge or credit your credit card as needed to account for any undercharge or overcharge errors, or to resubmit a failed or declined charge. 

Risk/Liability. You acknowledge the risk of injury to your person and property while participating in Missouri OHV Alliance-sanctioned events, and by accepting the Membership, you assume all risks of injury or damage arising out of participation in all Missouri OHV Alliance events. You agree to release, hold harmless and indemnify the Missouri OHV Alliance, its employees, directors, officers, agents, contractors, landowners, including the organizers of all Missouri OHV Alliance sanctioned events from all liability as a result of my participation in any such events.  This means that you agree not to sue the Missouri OHV Alliance for any resulting injury to yourself or your property at any Missouri OHV Alliance-sanctioned event.

Restrictions on Transfer.  Your Membership may not be transferred or used by any other party other than you. 

Your Information.  We expect Members to submit and maintain accurate and current user information in connection with their Memberships.  Such information includes name, address, e-mail address, and telephone number. Members can change their account information by contacting us at:

Disclaimers; Limitation of Liability.   Your Membership and its possible associated benefits are for use at your sole risk.  The possible membership benefits are provided on an "as is" and "as available" basis.  We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement, including but not limited to any services provided.  We make no warranty that (i) the Membership will meet your requirements or (ii) the quality of any products, services, or information obtained by you from your use of the Membership will meet your expectations.  We shall not be liable for any indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from any matters relating to the Membership program.  Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental, consequential or other damages.  Accordingly, some of the above limitations and exclusions may not apply to you.

Governing Law.  These Terms, and the respective rights and obligations of the parties hereunder, shall be governed by, and construed in accordance with, the laws of the State of Missouri, without regard to conflict of law principles. 

Acknowledgement.  These Terms, including all documents referenced herein, represents the entire understanding between us and any Member with respect to the Membership and supersedes any other agreements, statements or representations. Headings are for reference only and shall not affect the meaning of any part of the Terms.  All Members, by virtue of their Membership, are deemed to have accepted the terms and conditions of these Terms.

Changes to these Terms.  We may change these Terms at any time without notice or liability by posting revised Terms on the Missouri OHV Alliance website at www.MOHVA.org.  Any change shall take effect immediately, unless otherwise provided.  You may view the current version of these Terms at any time online at www.MOHVA.org You may also obtain a copy by contacting us at any time by writing at the following address:

The Missouri OHV Alliance Privacy Policy

The Missouri OHV Alliance (MOHVA) understands how valuable privacy is to our members and site visitors. This Privacy Policy explains how the MOHVA collects and uses personal information and how you can make your privacy preferences known.

You can access our Web site’s homepage and browse all of our content, without disclosing personal information.

We collect only non-personal information such as your computer’s IP address, your domain name, your operating system and your browser. This information is used to evaluate how you and other visitors use the MOHVA Web site and is not used to track your name, e-mail address or other personal data.

Personal information we collect
If you choose to join the MOHVA online, we will ask for personal information, including your name, address, telephone number, e-mail address, gender, birth date and riding preferences. This information is used for correspondence related to your membership and, may be used to contact you regarding certain other benefits or products of the MOHVA.

Children’s privacy
The MOHVA realizes that children may visit and use the MOHVA Web site. Therefore, we encourage parents, guardians and teachers to monitor children’s use of the Internet. Children should always get permission from their parents before sending any personal information about themselves over the Internet, to us or anyone else.

Use of cookies
We use cookies to recognize you, to record votes for our online polls, and to track membership sales from our affiliates. We also use cookies to collect anonymous traffic data to evaluate how you and other visitors use the MOHVA Web site. We do not use cookies to collect personal information.

You can set your browser so that it will not accept cookies.  You can use your browser’s help feature to learn more about disabling cookies.

Third-party advertising
MOHVA collects cookies on our Web site to capture information about page visits. This information is anonymous and MOHVA uses this information only internally - to deliver the most effective content to our visitors. Information from the cookies is used to gauge page popularity, analyze traffic patterns on our site and guide development of other improvements to our site. MOHVA does not require that you accept cookies, however, some functionality on our Web site, our product or service check-out process, and products and services may be disabled if you decline to accept cookies. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it. You may also change your cookie settings through preferences options in our products and/or services, where applicable. MOHVA never gives away information about our users. 
MOHVA uses analytics data and the DoubleClick cookie to serve ads based on a user's prior visits to our website.  Site visitors may opt out of the DoubleClick cookie by visiting the Google advertising opt-out page or they may opt out of Google Analytics by visiting the Google Analytics opt-out page.

How do we use your personal information?

Our primary purpose in using personal information we collect is to provide service for your MOHVA membership and provide you with products and services you request, such e-mail newsletters.

On occasion, unless you instruct us not to, we may also use your membership information to send you information about special offers, benefits and services provided by the MOHVA and its affiliates. If you do not wish to receive this information, please let us know by writing to us.

From time to time, unless you instruct us not to, we make our membership list available to other reputable organizations whose products or services we think you might find interesting. If you do not want us to share your address with other companies or organizations, please let us know by writing to us. 

Opting out
You can tell us if you do not want to receive information and offers from the MOHVA and its affiliates, other organizations or both by writing to us. 

E-mail policy
If you have received one of our e-mail newsletters and do not wish to continue receiving it, simply unsubscribe using the instructions provided in the e-mail.

 

Security of personal and payment information

When we transfer and receive certain types of sensitive information such as financial information, we redirect you to a secure server running SSL encryption technology. We also have appropriate security measures in place in our physical facilities to protect against the loss, misuse or alteration of information that we have collected from you at our site.

Glossary

Browser – A program that allows a user to find, view, hear and interact with material on the World Wide Web. Mozilla Firefox and Microsoft Internet Explorer are examples of popular browsers.

Cookies – Small text files that Web sites place in your computer to help your browser remember specific information. The MOHVA sites use cookies to record whether you have voted in one of our online polls and to verify that you are signed in to our members-only area.

IP Address – A unique number that specifically identifies each individual computer on the Internet. Depending on how your computer is connected to the Internet, it can either be a fixed set of numbers, or it can change each time you connect to your network or Internet service provider.

SSL – Secured Sockets Layer is a protocol that transmits your communications over the Internet in an encrypted form. SSL ensures that the information is sent, unchanged, only to the server you intended to send it to.
